68 Fed. Reg. 62163 (October 27, 2003) (proposed rule) (to be codified at 7 C.F.R. Part 247). This proposed rule would rewrite the regulations for the Commodity Supplemental Food Program in "plain language" to help program operators and the general public better understand program requirements. The effect of this rule will be to make the Commodity Supplemental Food Program easier to understand and administer, and more effective and efficient in providing benefits to eligible persons.

68 Fed. Reg. 2748 (January 21, 2003) (notice). This notice announces that the Food and Nutrition Service intends to continue to provide processors with an opportunity to participate in a demonstration project to test program changes in the State processing program. In the demonstration project, selected processors will be allowed to substitute donated beef and pork supplied by the Department of Agriculture with commercial beef and pork. Commercial beef and pork used in the demonstration project must meet the same specifications required of USDA donated beef and pork. Currently, there are no processors in the demonstration project substituting donated beef and pork with commercial beef and pork.

67 Fed. Reg. 65011 (October 23, 2002) (final rule) (to be codified at 7 C.F.R. Part 250). This final rule amends the USDA's Food Distribution Program regulations. The first part of this rule allows limited poultry substitution and full substitution of all other commodities except for beef and pork. The second part of this rule reduces current commodity recordkeeping and reporting requirements for some local level recipient agencies, such as schools. 250.30(f)(4) of the current regulations. Required Certified Public Accountant (CPA) audits have not shown any significant problems with these substitution options. No substitution of inferior or non-domestic product has been identified.

This notice announces that the Food and Nutrition Service, Food Distribution Division, will hold a meeting to discuss methods of value-pass-through of USDA donated commodities in food service management company fixed-rate-per- meal contracts in the National School Lunch Program. The purpose of this meeting is to offer State agencies, school food authorities, advocacy groups, food service management companies, and other interested parties the opportunity for dialogue prior to proposed rulemaking.
