Notice is hereby given of the intention of NRCS to issue a series of new or revised conservation practice standards in its National Handbook of Conservation Practices. These standards include: Closure of Waste Impoundments (Code 360), Cross Wind Trap Strips (Code 589C), Irrigation Water Management (Code 449), Land Reclamation, Landslide Treatment (Code 453), Mine Shaft and Adit Closing (Code 457), Pond Sealing or Lining, Compacted Clay Treatment (Code 521D), and Water Well (Code 642). NRCS State Conservationists who choose to adopt these practices for use within their States will incorporate them into Section IV of their respective electronic Field Office Technical Guides (eFOTG). These practices may be used in conservation systems that treat highly erodible land, or on land determined to be wetland.

The Natural Resources Conservation Service is issuing a final rule for technical service provider assistance as authorized under section 1242 of the Food Security Act of 1985 (Food Security Act), as amended by the Farm Security and Rural Investment Act of 2002, P.L. 107-171 (2002 Farm Bill). This final rule responds to comments received on the Interim Final Rule and two amendments, makes adjustments to the implementation of Technical Service Provider (TSP) assistance in response to these comments, and sets forth the final process for providing conservation technical assistance through technical service providers. The Secretary of Agriculture has delegated responsibility for administering technical services provided by technical service providers to NRCS.

The Natural Resources Conservation Service, United States Department of Agriculture, is amending soil survey regulations to reflect current law and contemporary conditions. The new rule clarifies soil survey operations and content of soil survey information; increases flexibility in disseminating soil surveys, including electronic dissemination; eliminates specific requirements to print and distribute soil survey reports; and corrects mailing addresses. These amendments are non-controversial changes to an existing regulation and are required to bring the regulation in conformity with statue. Therefore, NRCS believes that public notice is not needed and hereby issuing a final rule.

The Natural Resources Conservation Service (NRCS), United States Department of Agriculture (USDA) issues its final rule implementing the equitable relief authority and the procedures set forth at Section 1613 of the Farm Security and Rural Investment Act of 2002 (the 2002 Act), relating to relief for participants for covered programs administered by NRCS. The relief applies to cases where the applicant for relief took action to the applicant's detriment based on action or advice from departmental officials. This rule also addresses situations where the participant simply, but in good faith, failed to fully comply with program requirements. The rule implements Section 1613 as it applies to NRCS administered conservation programs.

The NRCS is issuing a proposed rule with a request for comments that implements the Conservation Security Program. This proposed rule describes how NRCS will implement the Conservation Security Program to provide financial and technical assistance to agricultural producers who conserve and improve the quality of soil, water, air, energy, plant and animal life, and support other conservation activities. This proposed rule also addresses public comments that NRCS solicited in an advanced notice of proposed rulemaking published February 18, 2003, in the Federal Register and other comments NRCS received in public workshops and focus groups. In addition, Congress is currently considering legislation that amends the Conservation Security Program statute. Pending the enactment of the legislation, NRCS intends to publish a supplement to this proposed rule. The supplement will amend the proposed rule to provide further guidance as to how the agency will implement Conservation Security Program and to address potential changes in law.
