The International Trade Commission is required to determine annually the U.S. domestic market for fuel ethyl alcohol during the 12-month period ending on the preceding September 30. The domestic market determination made by the Commission is to be used to establish the "base quantity" of imports that can be imported with a zero percent local feedstock requirement. For the 12-month period ending September 30, 2003, the Commission has determined the level of U.S. consumption of fuel ethyl alcohol to be 2.67 billion gallons. Seven percent of this amount is 186.9 million gallons (these figures have been rounded). Therefore, the base quantity for 2004 should be 186.9 million gallons.

68 Fed. Reg. 59586 (October 16, 2003) (notice). On February 28, 2003, Primera Harvest Co., Ltd. and Xiamen International Trade & Industrial Co., Ltd. (XITIC) requested a new shipper review of their sales. On March 28, 2003, the a notice of initiation of an antidumping duty new shipper review on certain preserved mushrooms from the People's Republic of China with respect to these companies was published. After analyzing XITIC's May 23, 2003, questionnaire responses, the Department of Commerce determined that XITIC did not produce the subject merchandise that it exported. Rather, XITIC exported subject merchandise that was produced by Inter-Foods D.S. Co., Ltd. Therefore, XITIC failed to provide the proper new shipper certification. On August 7, 2003, the Department of Commerce sent copies of this memorandum to the interested parties which stated that the parties had two weeks from the date of receipt to comment on the decision of the Department of Commerce to rescind this new shipper review. No party filed comments during the period stipulated the memorandum. Accordingly, the Internal Trade Commission is rescinding the new shipper review with respect to XITIC.
