The Food Safety and Inspection Service (FSIS) is publishing this document to inform slaughterers of young calves, including those marketed, slaughtered, and labeled as "veal," of the need for such firms to reassess their Hazard Analysis and Critical Control Point (HACCP) System, including prerequisite programs, with respect to animal drug residues and the use of unapproved new animal drugs.

This rule announces that the Food Safety and Inspection Service is establishing January 1, 2008, as the uniform compliance date for new food labeling regulations that are issued between January 1, 2005, and December 31, 2006. FSIS is establishing a uniform compliance date to minimize the economic impact of labeling changes by providing for an orderly industry adjustment to new labeling requirements that occur between the designated dates. Furthermore, FSIS is establishing the uniform compliance date approach in order to be consistent with the approach that the Department of Health and Human Services, Food and Drug Administration, has already established.

The report was written by the Agency's Listeria monocytogenes (L. monocytogenes) Assessment Team (Team) and presents the findings and recommendations of the Team which was responsible for assessing and measuring the effectiveness of the regulation to control L. monocytogenes in certain ready-to-eat (RTE) meat and poultry products. FSIS requests comments on the report. FSIS will consider the report and the comments on it, along with the comments that we receive on the interim final rule itself, in deriving a final rule on L. monocytogenes.

The Food Safety and Inspection Service (FSIS) is proposing to amend its regulations to change the required frequency of foreign inspection system supervisory visits to certified foreign establishments so as to bring FSIS import requirements into agreement with its requirements for domestic establishments. FSIS is proposing to delete the current requirement that supervisory visits take place "not less frequent[ly] than one such visit per month." In its place, FSIS is proposing to require foreign inspection systems to make "periodic supervisory visits" to certified establishments in order to ensure that such establishments continue to meet FSIS requirements for certification to export meat and poultry to the United States.

Following detection of bovine spongiform encephalopathy (BSE) in an imported dairy cow in Washington State in December 2003, the Secretaries of the U.S. Departments of Agriculture and Health and Human Services announced a series of regulatory actions and policy changes to strengthen protections against the spread of BSE in U.S. cattle and against human exposure to the BSE agent. The Secretary of Agriculture also convened an international panel of experts on BSE to review the U.S. response to the Washington case and make recommendations that could provide meaningful additional public or animal health benefits. The purpose of this advance notice of proposed rulemaking is to inform the public about the panel's recommendations and to solicit comment on additional measures under consideration based on those recommendations and other considerations.

The Food Safety and Inspection Service (FSIS) is holding a series of workshops from May through September, 2004, to discuss Revision 1 of Directive 10,010.1, "Microbiological Testing Program and Other Verification Activities for Escherichia coli O157:H7 (E. coli O157:H7) in Raw Ground Beef Products and Raw Ground Beef Components and Beef Patty Components." This directive provides FSIS inspection personnel with instructions for sampling raw beef products as part of verification testing for E. coli O157:H7. It also outlines actions FSIS will take when a raw ground beef product sample is found to be positive for E. coli O157:H7. Directive 5000.2, "Review of Establishment Data by Inspection Program Personnel" and Directive 6420.2, "Verification of Procedures for Controlling Fecal Material, Ingesta, and Milk in Slaughter Operations" will also be discussed. Directive 5000.2 states that FSIS will review plant food safety records at least once a week. Directive 6420.2 clarifies FSIS zero tolerance policies and verification methods. The meetings are targeted to small and very small plant owner/operators.

The Food Safety and Inspection Service (FSIS) is implementing the modified approach to the testing of meat carcasses for the presence of violative new animal drug residues, and disposition of product thereafter, as was announced in an August 6, 2001, Federal Register notice (66 FR 40964). This action will make FSIS' testing and disposition procedures consistent with the target tissue/marker residue policy of the Food and Drug Administration. FSIS is modifying its approach to ensure that meat containing unsafe levels of animal drug residues is not released into commerce.

The Food Safety and Inspection Service (FSIS) is announcing the availability of FSIS Directive 5000.2, "Review of Establishment Data by Inspection Program Personnel." In December 2003, the Agency issued FSIS Notice 54-03 "Review of Establishment Data by Inspection Program Personnel" to clarify that FSIS inspection program personnel have access to a wide range of establishment food safety records under the Hazard Analysis and Critical Control Point (HACCP) Systems regulations and to ensure that inspection program personnel understand that certain food safety records kept by the establishment are subject to review on a regular basis. FSIS has revised Notice 54-03 and is reissuing it as an FSIS Directive.

The Food Safety and Inspection Service (FSIS) is announcing the new dollar limitations on the amount of sales of meat and meat food products and poultry products to hotels, restaurants, and similar institutions that do not disqualify a retail store for exemption from Federal inspection requirements. By reason of FSIS' regulations, for calendar year 2004 the dollar limitation for meat and meat food products has been increased from $47,000 to $53,600 and for poultry products from $41,600 to $43,600. FSIS is increasing the dollar limitations from calendar year 2003 based on price changes for these products evidenced by the Consumer Price Index.

The Food Safety and Inspection Service (FSIS) is announcing that all parties required to register with the Agency, including those that are currently registered, have until May 24, 2004, to file the new registration form that the Agency has developed. On June 25, 2003, FSIS announced that it had developed the new registration form, and that all businesses required to register with FSIS were to submit the form by March 22, 2004. FSIS is extending the deadline for submitting the new registration forms because it was not available at the time FSIS projected that it would be available.

69 Fed. Reg. 1873 (January 12, 2004) (final rule) (to be codified at 9 C.F.R. Parts 301, 318, and 320). The Food Safety and Inspection Service is issuing this interim final rule on meat produced by advanced meat recovery systems. This new regulation is a prophylactic measure designed, in part, to prevent human exposure to the Bovine Spongiform Encephalopathy (BSE) agent by ensuring that advanced meat recovery systems are not a means of introducing central nervous system tissue into product labeled as "meat." In addition to the measures related to BSE, FSIS is finalizing restrictions related to bone solids and bone marrow for livestock products. This rule articulates the criteria that FSIS will use to ensure that advanced meat recovery products can be represented as "meat" and thus are not adulterated or misbranded. Finally, the Agency is requiring that Federally-inspected establishments that process the carcasses or parts of cattle develop, implement, and maintain written procedures for the removal, segregation, and disposition of specified risk materials, including non-complying product from beef advanced meat recovery systems. Establishments must incorporate these procedures into their HACCP plans or in their Sanitation SOPs or other prerequisite program. The FSIS is issuing this document as an interim final rule because of the discovery of a BSE-positive cow in this country.

69 Fed. Reg. 1861 (January 12, 2004) (final rule) (to be codified at 9 C.F.R. Parts 301, 309, et al.). The Food Safety and Inspection Service is amending the Federal meat inspection regulations to designate the brain, skull, eyes, trigeminal ganglia, spinal cord, vertebral column (excluding the vertebrae of the tail, the transverse processes of the thoracic and lumbar vertebrae, and the wings of the sacrum), and dorsal root ganglia of cattle 30 months of age and older, and the tonsils and distal ileum of the small intestine of all cattle, as "specified risk materials" (SRMs). The Agency is declaring that SRMs are inedible and prohibiting their use for human food. In addition, FSIS is requiring that all non-ambulatory disabled cattle presented for slaughter be condemned. The Agency is requiring that federally-inspected establishments that slaughter cattle and federally-inspected establishments that process the carcasses or parts of cattle develop, implement, and maintain written procedures for the removal, segregation, and disposition of SRMs. Establishments must incorporate these procedures into their HACCP plans or in their Sanitation SOPs or other prerequisite program. FSIS is taking this action in response to the diagnosis on December 23, 2003, by the U.S. Department of Agriculture of a positive case of bovine spongiform encephalopathy (BSE) in an adult Holstein cow in the State of Washington.

This final rule announces that the Food Safety Inspection Service intends to increase its enforcement of the registration and recordkeeping requirements to ensure that all businesses subject to the Federal Meat Inspection Act and Federal Poultry Products Inspection Act that are required to be registered with the Food Safety Inspection Service and/or to maintain business records are properly doing so. The Food Safety Inspection Service is also informing the public that it has developed a new registration form. Because this form requires that registrants provide certain information that was not required on the previous form, all parties required to register, including those that are currently registered, must complete the new form and submit it to the Food Safety Inspection Service.

The Food Safety and Inspection Service is amending its regulations to require that official establishments that produce certain ready-to-eat meat and poultry productsprevent product adulteration by the pathogenic environmental contaminant Listeria monocytogenes. In particular, under these regulations, establishments that produce ready-to-eat meat and poultry products that are exposed to the environment after lethality treatments and that support the growth of L. monocytogenes will be required to have, in their hazard analysis and critical control point plans, or in their sanitation standard operating procedures or other prerequisite programs, controls that prevent product adulteration by L. monocytogenes. The establishments must share with FSIS data and information relevant to their controls for L. monocytogenes. The establishments also must furnish FSIS with information on the production volume of products affected by the regulations.

The Food Safety and Inspection Service is proposing to amend its nutrition labeling regulations to change the definition of ``meal-type'' products to allow for nutrient content claims on multiple-serve food containers, to adopt the definition of ``main dish'' used by the Food and Drug Administration, and to define how meal-type products and main dishes should be nutritionally labeled. The change in the definition of meal-type products would allow nutrient content claims to be based on 100 grams of product rather than on the serving size, which is based on the Reference Amounts Customarily Consumed for the food components.
