The Rural Business-Cooperative Service (RBS) revises its regulations to incorporate provisions outlined in the 2002 Farm Bill. This proposed rule invites comments on a new program, the 2004 Ewe Lamb Replacement and Retention Payment Program, as authorized by clause (3) of section 32 of the Act of August 24, 1935, as amended. The proposed program will assist producers of sheep and lambs by providing up to $18 million total, in direct cash payments, to encourage the replacement and retention of ewe lamb breeding stock during the one-year period from August 1, 2003, through July 31, 2004. This action is designed to provide immediate financial assistance to sheep and lamb producers who have recently experienced reduced production and flock size, low prices and poor market conditions.

The Farm Service Agency (FSA) is amending its regulations governing servicing of loans made under the guaranteed farm loan program. This rule will allow loans to be rescheduled with balloon payments under certain circumstances and allow the approval of certain low-risk subordinations at the field office level instead of the National Office. It will also allow lenders to make debt installment payments in accordance with lien priorities, payment due dates, and clarify that packager and consultant fees for servicing of guaranteed loans are not covered by the guarantee.

69 Fed. Reg. 30997 (June 2, 2004) (final rule) (to be codified at 1910, 1941, and 1965). This rule amends the Farm Service Agency's (FSA) regulations governing real estate and chattel appraisals. In loan making, the rule allows FSA to obtain appraisals after loan funds become available and the applicant is determined eligible. Also, the rule increases the dollar threshold that determines when a real estate appraisal is required. In loan servicing, the rule raises the dollar threshold for real estate appraisals in partial release situations and allows the FSA in some cases to release real estate security without appraising the retained real estate. These changes will reduce FSA's appraisal costs and enhance the timeliness of program delivery of certain loan making and servicing actions.

The Rural Business-Cooperative Service is amending the regulation to recognize a transition formula that will be used for allocating funds to State Offices. This action is needed due to the significant impact the use of the new 2000 U.S. Census data versus the 1990 U.S. Census data, used in previous years, will have on certain States' allocations.

69 Fed. Reg. 5264 (February 4, 2004) (final rule) (to be codified at 7 C.F.R. Parts 1951, 1962, and 1965). The Farm Service Agency is amending its regulations to eliminate the 30-day past-due period prior to a determination that the borrower is delinquent and clarify the use of the terms "delinquent" and "past due" with regard to direct loan servicing and offset. Because the regulation only allows debt writedown after a borrower becomes delinquent, this change would allow Farm Loan Programs borrowers to receive debt writedown on the day after a missed payment, assuming all other primary loan servicing criteria are met, instead of waiting 31 days.

69 Fed. Reg. 5259 (February 4, 2004) (final rule) (to be codified at 7 C.F.R. Part 762). This rule amends the Farm Service Agency's regulations for direct and guaranteed farm loans to implement provisions of the 2002 Farm Bill. Specifically, the rule provides that borrowers who are current on an FSA loan before the beginning date of the incidence period of a Presidentially-declared disaster or emergency, but who receive debt forgiveness on that loan following the disaster, are eligible for direct and guaranteed operating loan assistance if all other regulatory requirements are met. It also amends the regulations for direct farm ownership loans by making applicants eligible if they participated in the business operations of a farm or ranch for at least three of the past 10 years and meet other regulatory requirements. In addition, the rule amends regulations concerning reamortization of amortized Shared Appreciation Agreement recapture debt.

69 Fed. Reg. 2999 (January 22, 2004) (final rule) (to be codified at 7 C.F.R. Part 1951). This action amends the regulations governing the servicing of Rural Business-Cooperative Service loan and grant programs by adding a section to clarify that any amounts paid by the Rural Business-Cooperative Service on account of the liabilities of a guaranteed loan borrower will constitute a Federal debt owing to it by the guaranteed loan borrower. The Rural Business-Cooperative Service may use all remedies available to it, including offset under the Debt Collection Improvement Act, to collect the debt from the borrower.

This action is necessary since existing regulations are obsolete and do not accurately reflect the current payment and collections methodologies employed by the Agencies. The intended effect is to simplify and update the regulations; update internal control procedures for safeguarding collections; remove references to the Concentration Banking System procedures which were eliminated in November 1997; and to add procedures for new electronic payment methods that are currently in use by the Agencies. These amended regulations are to ensure the Agencies' field offices have current guidance on the payment and collection methods available and how to use them.

It reduces the amortization rate on SAA recapture obligations to the current Homestead Protection Program interest rate less 100 basis points (one percent) pursuant to a statutory mandate. The amortization rate on all recapture obligations in existence as of October 28, 2000, will be similarly reduced.

67 Fed. Reg. 791 (Jan. 8, 2002) (to be codified at 7 C.F.R. pt. 764, 1945). This final rule amends the regulations governing the FSA Emergency Farm Loan Program. It eliminates the Emergency Loan Program regulations at 7 C.F.R. pt.1945 and replaces them with new regulations found at 7 C.F.R. pt. 764. Under the new regulations, the application process is simplified, and several changes are made to make loans more easily available to farmers experiencing losses. In particular, the new regulation changes the treatment and calculation of livestock losses. This rule was effective as of February 7, 2002.
