In accordance with the Federal Insecticide, Fungicide, and Rodenticide Act, EPA is issuing a notice of receipt of a request by the registrant to voluntarily terminate the following uses of the 15% granular formulation of disulfoton (DiSyston 15G): Beans, Brussels sprouts, cabbage, cauliflower, cotton, peanuts, peppers, radish grown for seed, and clover grown for seed. The registrant will retain use of Di-Syston 15G on Fraser fir Christmas trees in North Carolina and coffee trees in Puerto Rico, provided that it is used with a new closed system applicator. DiSyston 15G is not the last disulfoton product registered for agricultural use in the United States. The registrant will retain the registration of DiSyston 8E, the liquid emulsifiable concentrate, which must also be used with closed systems. However, EPA intends to grant this request to terminate these uses at the close of the comment period for this announcement unless the Agency receives substantive comments within the comment period that would merit its further review of this request, or unless the registrant withdraws their request within this period. Upon acceptance of this request, any sale, distribution, or use of products listed in this notice will be permitted only if such sale, distribution, or use is consistent with the terms as described in the final order.

This regulation establishes time-limited tolerances for combined residues of hexythiazox (trans-5-(4-chlorophenyl)-N- cyclohexyl-4-methyl-2-oxothiazolidine-3-carboxamide) and its metabolites containing the (4-chlorophenyl)-4-methyl-2-oxo-3- thiazolidine moiety or on field corn grain, stover, and fodderhis action is in response to EPA's granting of an emergency exemption under the Federal Insecticide, Fungicide, and Rodenticide Act authorizing use of thepesticide on field corn. This regulation establishes maximum permissible levels for residues of hexythiazox in these food commodities. The tolerances will expire and are revoked on December 31, 2007.

The regulation establishes technology-based narrative limitations and standards for wastewater discharges from new and existing concentrated aquatic animal production facilities that discharge directly to U.S. waters.

Pursuant to a request by EPA and as required by the regulations, the State of Louisiana has submitted a request for approval of revisions to the Louisiana Pollutant Discharge Elimination System (LPDES) program, which was originally approved on August 26, 1996. Through the submission of the revised program authorization documents, including a complete program description, a Memorandum of Agreement (MOA) with EPA Region 6, and an Attorney General's Statement, the Louisiana Department of Environmental Quality (LDEQ) seeks approval of the proposed revisions to the LPDES program. Today, EPA Region 6 is providing public notice of its intent to approve the proposed revisions to the LPDES program and announcing a 30-day public comment period on the proposed revisions accompanied by an opportunity for a public hearing, if requested. EPA will either approve or disapprove the State's request based upon the requirements after considering all comments received. EPA and LDEQ want the citizens of Louisiana to understand the proposed revisions to the LPDES program and encourage public participation in the decision making process. Therefore, EPA requests that the public review the revised program documents and provide any appropriate comments.

The Environmental Protection Agency (EPA) promulgated effluent limitations guidelines (ELGs) and New Source Performance Standards (NSPS) for Concentrated Animal Feeding Operations on February 14, 1974. EPA promulgated revised CAFO ELGs and NSPS on February 12, 2003. Among other things, the new ELGs apply to facilities that were not covered by the 1974 ELGs, and require all CAFOs to apply for permit coverage. EPA Region 6 now proposes to reissue GPs for the states of Oklahoma and New Mexico, and Indian lands in Oklahoma and New Mexico. All CAFOs that were subject to either the 1974 NSPS or the 2003 NSPS when they commenced construction, meet the new source criteria at 40 CFR 129.29 and are new source facilities for purposes of NEPA review.

In response to a citizen suit filed under the Endangered Species Act against the Environmental Protection Agency (EPA) by the Washington Toxics Coalition and other public interest groups, the United States District Court for the Western District of Washington issued an Order granting interim injunctive relief on January 22, 2004. The Order (with some exceptions) enjoins, vacates and sets aside EPA's authorization of certain pesticides' uses within 20 yards for ground applications and 100 yards for aerial applications, adjacent to salmon supporting waters in California, Oregon and Washington, effectively establishing buffer zones around those waters. The Order contained other requirements, which are detailed in the full text of this notice.

The Environmental Protection Agency is publishing the results of its review of regulations under the Clean Water Act governing the use and disposal of sewage sludge. The Clean Water Act requires that EPA review the sewage sludge regulations for the purpose of identifying additional toxic pollutants and promulgating regulations for such pollutants consistent with the requirements. As part of this review, EPA commissioned the National Research Council of the National Academy of Sciences to independently review the technical basis of the chemical and microbial regulations applicable to sewage sludge that is applied to land. In July 2002, the NRC published a report entitled ``Biosolids Applied to Land: Advancing Standards and Practices'' in response to the EPA's request. In April 2003 EPA announced and requested public comments on a preliminary strategy explaining how EPA planned to respond to the National Research Council report recommendations. Today, the Agency is announcing its final response, also known as the final action plan, to the National Research Council report. EPA is also presenting the results of its review of existing sewage sludge regulations to identify additional toxic pollutants in sewage sludge for potential future regulations.

It is intended to ensure that concentrated animal feeding operations take appropriate actions to manage manure effectively in order to protect the nation's water quality. The rule revises two sections of the Code of Federal Regulations, the National Pollutant Discharge Elimination System permitting requirements for CAFOs and the Effluent Limitations Guidelines and Standards for concentrated animal feeding operations. The Environmental Protection Agency believes that these regulations will substantially benefit human health and the environment by assuring that an estimated 15,500 concentrated animal feeding operations effectively manage the 300 million tons of manure that they produce annually.
