This final rules establishes that the Animal and Plant Health Inspection Service is amending the regulations governing the importation of certain animals, meat, and other animal products by adding Great Britain to the list of regions considered free of rinderpest and foot-and-mouth disease and to the list of regions subject to certain import restrictions on meat and animal products because of their proximity to or trading relationships with rinderpest- or FMD-affected regions.

This interim rule establishes that in accordance with the Agricultural Bioterrorism Protection Act of 2002, the Animal and Plant Health Inspection Service is establishing, by regulation, standards and procedures governing the possession, use, and transfer of biological agents and toxins that have been determined to have the potential to pose a severe threat to both human and animal health, to animal health, to plant health, or to animal and plant products.

This notice announces that the Animal and Plant Health Inspection Service is advising the public that it has prepared an environmental assessment and finding of no significant impact relative to the control of rush skeletonweed (Chondrilla juncea). The environmental assessment considers the effects of, and alternatives to, the release of a nonindigenous organism, Chondrilla root moth (Bradyrrhoa gilveolella), into the environment for use as a biological control agent to reduce the severity of rush skeletonweed infestations. Based on its finding of no significant impact, the Animal and Plant Health Inspection Service has determined that an environmental impact statement need not be prepared.

This environmental assessment considers the effects of, and alternatives to, the release of nonindigenous organisms into the environment for use as biological control agents to reduce the severity of Pacific mealybug infestations.

67 Fed. Reg. 70864 (November 27, 2002) (proposed rule) (to be codified at 9 C.F.R. Part 71). The Animal and Plant Health Inspection Service is proposing a rule that would establish requirements for the collection of blood and tissue samples from livestock (horses, cattle, bison, captive cervids, sheep and goats, swine, and other farm animals) and poultry at slaughtering establishments when it is necessary for disease surveillance. The Service is also proposing that any person who moves or causes the movement of livestock or poultry interstate for slaughter may only move the animals to a slaughtering establishment that has been listed by the Administrator.

67 Fed. Reg. 70674 (November 26, 2002) (interim rule) (to be codified at 9 C.F.R. Part 82). This interim rule amends the exotic Newcastle disease regulations by quarantining Los Angeles County, CA, and portions of Riverside and San Bernardino Counties, CA, and restricting the interstate movement of birds, poultry, products, and materials that could spread exotic Newcastle disease from the quarantined area. This action is necessary on an emergency basis to prevent the interstate spread of exotic Newcastle disease from the quarantined area.

67 Fed. Reg. 68021 (November 8, 2002) (final rule) (to be codified at 9 C.F.R. Parts 93 and 98). This final rules establishes that the Animal and Plant Health Inspection Service is amending its regulations by removing Blaine and Lynden, WA, from the lists of Canadian border ports designated as ports of entry for the importation of certain animals, birds, poultry, and animal germ plasm into the United States. This rule will update the regulations so that they accurately reflect the ports used for the importation of certain animals and animal semen into the United States.

This notice announces that the Animal and Plant Health Inspection Service is advising the public that it has prepared a pest risk assessment relative to a proposed rule currently under consideration that would allow the importation of Unshu oranges from the Republic of Korea into citrus producing States of the continental United States. This pest risk assessment is available to the public for review and comment.

This final rule establishes that the Animal and Plant Health Inspection Service is amending its general indemnity regulations to allow the USDA to indemnify contract growers and owners for poultry destroyed because of low pathogenic avian influenza associated with a disease situation in Virginia.

This final rule establishes that the Animal and Plant Health Inspection Service is adopting as a final rule, without change, an interim rule that amended the regulations by adding Israel to the list of regions where bovine spongiform encephalopathy exists because the disease had been detected in a native-born animal in that region. The interim rule placed a restriction on the importation of ruminants, meat, meat products, and certain other products of ruminants that had been in Israel.

This notice announces that the Animal and Plant Health Inspection Service is advising the public of its determination that the Monsanto Company corn designated as Event MON 863, which has been genetically engineered for insect resistance, is no longer considered a regulated article under its regulations governing the introduction of certain genetically engineered organisms and products. This determination is based on the Service's evaluation of data submitted by Monsanto Company in its petition for a determination of nonregulated status, our analysis of other scientific data, and comments received from the public in response to a previous notice.

This final rule announces that the Animal and Plant Health Inspection Service is amending the Karnal bunt regulations to make changes to the list of areas or fields regulated because of Karnal bunt, a fungal disease of wheat. These actions are necessary to help prevent the spread of Karnal bunt into noninfected areas of the United States, and to relieve restrictions that are no longer warranted.

This proposed rules announces that the Animal and Plant Inspection Service is reopening the comment period for the proposed rule that would amend the regulations pertaining to the importation of horses to establish standards for the approval of permanent, privately owned quarantine facilities for horses.

67 Fed. Reg. 61293 (September 30, 2002) (proposed rule) (to be codified at 9 C.F.R. Part 94). We are proposing to amend the regulations by adding the Mexican States of Campeche, Quintana Roo, Sonora, and Yucatan to the list of regions considered free of classical swine fever. We have conducted a series of risk evaluations and have determined that these four States have met our requirements for being recognized as free of this disease. This proposed action would allow importation into the United States of pork, pork products, live swine, and swine semen from these regions and would eliminate restrictions that no longer appear necessary.

This final rule adopts, without any changes, an interim rule that amended the Texas fever in cattle regulations by updating the incorporation by reference of the Texas Animal Health Commission regulations that contain the description of the areas in Texas quarantined because of ticks.

This final rule announces that the definitions of "biological agents" and "toxins" found in the August 12, 2002, regulations that listed biological agents and toxins determined to have the potential to pose a severe threat to animal or plant health, or to animal or plant products, and that required all persons in possession of any listed biological agent or toxin to notify the Secretary of such possession have been updated to reflect the amendments made by the Public Health Security and Bioterrorism Preparedness and Response Act of 2002.

This interim rule is intended to remove Denmark from the list of regions considered free of exotic Newcastle disease. This action restricts the importation of poultry carcasses, parts or products of poultry carcasses, and eggs (other than hatching eggs) of poultry, game birds, or other birds from Denmark.

67 Fed. Reg. 48745 (July 26, 2002) (interim rule) (to be codified at 9 C.F.R. Part 50). This interim rule amends the regulations pertaining to payments made in connection with animals and other property disposed of because of bovine tuberculosis to provide that the Animal and Plant Health Inspection Service will make payments to owners of dairy cattle and other property used in connection with a dairy business, and a dairy processing plant in the area of El Paso, TX. The owners must agree to dispose of their herds, close their existing dairy operations, and refrain from establishing new cattle breeding operations in the area.

This interim final rule amends the regulations by adding Israel to the list of regions where bovine spongiform encephalopathy exists because the disease has been detected in a native-born animal in that region. The effect of this interim final rule is to restrict the importation of ruminants that have been in Israel and meat, meat products, and certain other products of ruminants that have been in Israel.

This notice announces that an evaluation has been prepared by the Animal and Plant Health Inspection Service concerning the foot-and-mouth disease status of Great Britain and the related disease risks associated with importing animals and animal products into the United States from Great Britain. This evaluation will be used as a basis for determining whether to relieve certain prohibitions and restrictions on the importation of ruminants and swine and fresh (chilled or frozen) meat and other products of ruminants and swine into the United States from Great Britain.
